Quit4Wellbeing privacy notice

Privacy notice specifically for Quit4Wellbeing a West Sussex County Council (WSCC) specialist stop smoking service.

Quit4Wellbeing launched in October 2024 and is a specialist stop smoking service for residents living or working in West Sussex. The service provides support and facilitates stop smoking treatments for adults (18 years or older) who wish to quit smoking tobacco.

The service accepts referrals from smokers in West Sussex, as well as from healthcare professionals, to help residents access the most suitable support for quitting smoking.

This support will include providing information, advice and guidance, and where appropriate, signposting or referring to alternative sources of support to quit smoking.

This privacy notice explains:

  • how personal information is going to be used
  • what it is used for
  • who it might be shared with and why
  • how long it is kept.

The information you provide helps us deliver our services effectively.

Personal and special category data

The categories of personal data we are processing are:

  • name
  • date of birth
  • contact details (address, email, phone numbers)
  • gender
  • ethnicity
  • sexual orientation
  • occupation
  • pregnancy status
  • GP surgery name
  • whether or not you pay for NHS prescription charges

The special category personal data we are processing are:

  • Health or medical information, including existing physical and mental health conditions and current medications which may impact the range of smoking cessation medications available to you to support your quit smoking attempt
  • other special category personal data captured include sexual orientation and ethnicity, which help identify and address health inequalities, improve services, and ensure equitable access to stop smoking support for all communities

We may also receive personal information indirectly, from the following sources in the following scenarios:

  • a friend or family member referring you for stop smoking support (with your consent)
  • healthcare professionals (with your consent)
  • a local stop smoking service commissioned by WSCC or an NHS Trust's Tobacco Dependency Service
  • other local authorities (depending on where you live or work, and onward referral will be offered to you to access the most suitable service, which may sit within another local authority - with your consent)

There are a number of reasons why we need to collect and use your personal information. Generally, we collect and use personal information where:

  • to contact you, and support you to stop smoking which may include sending you medication (nicotine replacement products)
  • to fulfil national monitoring requirements and comply with legal and reporting obligations set by the Department of Health and Social Care

  • protecting public health is essential, and we may collect and use personal information to support efforts to improve population health and implement harm reduction strategies for West Sussex residents
  • West Sussex County Council has a legal and statutory duty to protect individuals from harm in emergencies.
  • your data may be used for archiving, research, or statistical purposes. In these cases, it will be processed in a pseudonymised format, meaning your name and other identifying details will be replaced with a unique number to protect your privacy.

Data Controller

West Sussex County Council (WSCC) complies with the Data Protection Act and the UK General Data Protection Regulation (GDPR). It is registered as a ‘Data Controller’ with the Information Commissioner’s Office (Reg. No. Z6413427).

We ensure that your personal data is accurate, processed fairly and lawfully, kept secure and retained for no longer than is necessary.

The legal basis for processing personal data

Our lawful basis for processing your personal data is UK GPDR:

  • Article 6(1)(e) - Processing is necessary for the performance of a public task given to local authorities to provide stop smoking services
  • Article 6 (1)(a) – by choosing to complete the satisfaction survey you consent to process the data you provide. This data will be anonymous unless you provide your contact details to take part in further feedback.

Our lawful basis to process your special category data is UK GDPR:

  • Article 9(2)(h) - Processing is necessary for the purposes of health or social care (Data Protection Act 2019, Schedule 1, Part 1, para.2)

How we use your personal information

Our Privacy Policy determines how we use personal data. We use it specifically to:

  • assess eligibility and suitability for smoking cessation support and treatment, which may include smoking cessation medications

This list may change, however, any use of data will be proportionate and necessary for the delivery of those efforts.

We may pass data to:

  • external partners who may be able to help you, such as alternative smoking cessation providers.  You will have given your consent for us to do this.

How long we keep your personal data

Personal data will not be retained for longer than is necessary in relation to the purposes for which they are collected.
